By accessing or using WebGeno ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
WebGeno is a web-based genogram builder application designed for mental health professionals, family therapists, and researchers. The Service allows users to create, edit, save, and export family genograms with various relationship mappings and health condition tracking.

Payments are processed securely through Stripe. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.
All subscription fees are non-refundable except where required by mandatory applicable law. If you cancel your subscription:
If you believe you have been charged in error, please contact us at support@psychologysmarttools.com within 30 days of the charge and we will investigate promptly. EU consumers retain their statutory right to a 14-day cooling-off period for digital services where the service has not yet commenced; if you have already accessed Professional features during this period, you acknowledge that the right of withdrawal may be lost under applicable consumer law.
New users may be eligible for a 7-day free trial of the Professional tier. During the trial period, you will have access to all Professional features. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
You retain ownership of all genograms and data you create using the Service. By using cloud storage features, you grant us a limited license to store and transmit your data solely for the purpose of providing the Service.
You are solely responsible for ensuring that any data you input complies with applicable privacy laws and regulations, including obtaining necessary consents when inputting information about third parties.
When mental health professionals use WebGeno to process data relating to their clients, the following applies under data protection law:

WebGeno is a tool to assist professionals in creating genograms. It is not a substitute for professional judgment, clinical assessment, or therapeutic intervention. Users are responsible for the appropriate use of genograms in their professional practice.

WebGeno provides automatic name detection and anonymization when using AI-powered features. Personal names are replaced with placeholders before being sent to external AI providers, and original names are restored locally after processing.
User Responsibility: While we implement privacy-by-design principles aligned with EU regulations including GDPR and the EU AI Act, the effectiveness of our anonymization depends on your active participation:
WebGeno cannot guarantee complete anonymization of all personal identifiable information. By using AI features, you acknowledge this shared responsibility and agree to take reasonable steps to verify anonymization before processing.
The Service, including its design, features, and content (excluding user-generated content), is owned by WebGeno and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBGENO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
WebGeno does not guarantee any specific level of uptime or availability. We will use commercially reasonable efforts to maintain the Service and minimise planned and unplanned downtime. Scheduled maintenance will be communicated in advance where practicable.
The Service may be temporarily unavailable due to maintenance, technical failures, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service interruptions. Critical genogram data should be exported and backed up regularly.
You agree to indemnify and hold harmless WebGeno and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. You may export your data before termination.
You may terminate your account at any time by contacting us or using the account deletion feature in the application settings.
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified terms.
In the event of a dispute arising out of or relating to these Terms or your use of the Service, the parties agree to the following process:
Nothing in this section prevents you from filing a complaint with a consumer protection authority or data protection supervisory authority in your country.
These Terms are governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. EU users retain all rights granted under mandatory EU consumer protection legislation, which shall prevail over these Terms to the extent of any inconsistency. Users outside the EU are subject to Portuguese law to the fullest extent permitted in their jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
